The Common Council met at City Hall in the City of Black River Falls on July 2, 2019 at 6:00 P.M. Alderpersons Olson, Busse, Gearing-Lancaster, Brown, J. Rave, and M. Rave were present. Alderperson Ross was excused. Mayor J. Eddy presided.

CITY OF BLACK RIVER FALLS RESOLUTION 2019-05 A RESOLUTION REGULATING THE USE OF MUNICIPAL RIGHTS-OF-WAY
The Common Council of the City of Black River Falls, Jackson County, WI, does resolve as follows: WHEREAS, the Common Council of the City of Black River Falls has determined that in order to protect the health, safety and welfare of the City and its residents, it needs to regulate the use of municipal rights-of-way
within the City municipal limits.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL FOR THE CITY OF BLACK RIVER FALLS, WISCONSIN:
1. No party shall be allowed to use the municipal rights-of-way unless specifically allowed to do so by law.
2. Any party authorized by law to use the municipal rights-of-way shall be required, prior to use of said
right-of-way, to give thirty-five (35) days’ notice of intent to use said right-of way.
3. The notice required in provision (2) above shall include the following:
a) Utility right–of-way construction plans and field sketches for the proposed facilities to be placed in the right-of-way.
b) A detailed description of the planned use, the anticipated dates of entry upon the right-of-way and the advanced excavation work plans in order for the City to coordinate work within the right-of-way.
4. Any party authorized by law to use the municipal rights-of-way shall be required, prior to use of said right-of-way, to obtain a permit for the entry upon and use of the public right-of-way.
5. The permit required by provision (4) above shall be called a “Pre-Excavation Permit” and the fee shall be $5,000.00. This fee shall be used to hire an engineering firm to manage the functions found in PSC 130.05(1)(a – h), to hire legal counsel to review any application, and to reimburse the City of Black River
Falls for actual employee time spent on a function found in PSC 130.05(1)(a – h). Any portion of the fee not used by the City shall be promptly returned to the applicant.
6. Any party authorized by law to use the municipal rights-of-way shall be required to restore the right-ofway which they have disturbed as close as is practically possible to its pre-excavation condition.
7. The City may also require reasonable bonding and insurance requirements as deemed appropriate by legal counsel for the City per PSC 130.06.

The Common Council for the City of Black River Falls, Jackson County, Wisconsin hereby resolves to adopt the following fee schedule to be effective July 3, 2019 through December 31, 2019. Be it further resolved this fee schedule shall be reviewed and adopted annually.
